Collective Arts Limited, its subsidiaries, and affiliates, and affiliated brands, agents, trusted service vendors/providers, and corporate affiliates acting on our behalf (“Collective Arts”, “we”, “us”, and “our”) values and respects the privacy of every individual. We are providing this Privacy Policy to help you understand how we collect, use, transfer, disclose, and store your Information (as defined below).
We encourage you to read the entire Privacy Policy to familiarize yourself with our practices.
1. ACCESS RESTRICTED TO INDIVIDUALS OF LEGAL DRINKING AGE
COLLECTIVE ARTS SITES AND ADVERTISING ARE INTENDED ONLY FOR PERSONS OF LEGAL DRINKING AGE BASED ON THE JURISDICTION WHERE SUCH CONTENT IS BEING ACCESSED OR VIEWED. YOU WILL BE REQUIRED TO VERIFY YOUR DATE OF BIRTH PRIOR TO ENTERING OR INTERACTING WITH A SITE. AGE VERIFICATION PROMPTS MAY ALSO BE LOCATED WITHIN THE SITES.
WE DO NOT KNOWINGLY COLLECT INFORMATION FROM THOSE UNDER THE LEGAL DRINKING. IF YOU ARE UNDER THE LEGAL DRINKING AGE IN YOUR JURISDICTION AND HAVE ENTERED OUR SITE BY PROVIDING A FALSE DATE OF BIRTH, YOU MUST IMMEDIATELY LEAVE THE SITE. 2. WHEN DOES THIS PRIVACY POLICY APPLY?
This Privacy Policy describes our practices in connection with the information collected from individuals interacting with us and our Sites, products and services, including our websites, social media pages and promotional sites that we control, widgets and mobile sites and applications, our reward programs, blogs, interactive applications, chat bots, emails and text messages (SMS and MMS) that we send to you, and other interactive features (each a “Site,” collectively the “Sites”), through our online advertisements on third-party websites, and through vendors/sources from which we source information.
3. COLLECTION AND USE OF PERSONAL INFORMATION
Below are examples of how we collect and use personal information on our Site:
A. Visit our Site: In order to access our Site, we may require you to enter your date of birth and jurisdiction of residence to verify that you are the age of majority in your jurisdiction of residence in order to meet regulatory requirements.
B. Create an Account: To access and use our Site, you may be required to create an account. When you create an account, we may collect personal information such as your first and last name, email address, birth date, gender (optional) and a password that you create. We use this information to create and administer your account and to provide the products and services you request. We strongly recommend that you do not disclose your password to anyone. We will never ask you for your password in any unsolicited communication (such as letters, phone calls or email messages). If you become aware of any unauthorized access to or use of your account, you are required to notify us immediately.
C. Purchase Products and Services: If you are making a purchase on the Site, we (or our authorized third-party payment processor) may collect payment information (including billing address, credit card number, expiry data and CVV code) in order to process the transaction. In such event, it is our policy to redirect you to a payment processing portal hosted by a third-party payment processor. Please read the privacy policy on our payment processor’s website regarding the use, storage and protection of your credit card information before submitting any payment information.
D. Marketing: If you choose to sign-up for or engage with our marketing communications, we may send you special offers, e-blasts, and information about other services that we believe may be of interest to you. We will collect certain information such as your name, date of birth (to verify your age), postal code (to verify your jurisdiction of residence) and email address. If you no longer wish to receive these communications, you may unsubscribe any time by clicking the “unsubscribe” link at the bottom of the email or by contacting us at the contact information under “Contact Us” below. Please note that you may continue to receive certain transactional or account-related communications from us.
E. If you engage with any organic content, sponsored content and advertising content on social and digital channels such as engaging with an influencer’s post, “liking” our posts, or watching content we’ve posted, we may collect information (e.g. likes, shares, and comments) for the purposes of evaluating the effectiveness of our marketing campaign, targeting future content in more relevant ways, or improving future marketing efforts.
F. We may also use services provided by third-party Sites (such as social media and other websites) to serve targeted advertisements on such Sites to you or others, and we may provide a hashed version of your email address or other information to the Site provider for such purposes. To opt-out of the use of your information for such purposes, please send a request using any of the methods set forth in the Contact Us section below.
G. Location Information: With your consent, we may collect your location information by accessing your device’s GPS coordinates so that we can provide you with location-based services. You can opt-out of location tracking at any time by turning off your location services for the Site in the settings of your device.
H. Push Notifications: If you provide your consent to receive push notifications, we may display push notifications on your mobile device such as welcome messages, product features and promotional offers. If you wish to stop receiving push notifications from us, you can turn off push notifications for the Site in the settings of your device.
I. Contests, Promotions and Redemptions: When you enter a contest or participate in a promotion, we may collect your name, date of birth, address, phone number, email address, and other information you provide. We use this information to administer your participation in the contest or promotion and fulfil your prize. We may collect this information through our Site or different devices, such as a tablet or other mobile device, including at events or venues as part of an on-site promotion or offline using forms or paper entries.
J. Contact Us: When you contact us with a comment or question through email, telephone, or the Contact Us form on our Site, you may provide information that identifies you, such as your name, email, address, birth date or telephone number, along with additional information we need to help us promptly respond. We may retain this information to assist you in the future and to improve our products and services and to customize your experience with us, including to help us diagnose problems with our server or other technical issues relating to the performance of the Site.
K. Business Partners: We may collect information about you from third parties such as from our business partners. We may use this information to conduct research and analysis, improve our marketing efforts, inform product development and innovation, and for supply and logistics improvements. We and our business partners may combine information that we have collected offline with information we collect online and across different devices over time.
L. Community Forums/Public Spaces: We may collect information you post on a public space such as a community forum on the Site. Note about third-party uses: If you voluntarily disclose personal information (e.g., name, email address, personal photographs) in a community forum, such information may be collected and used by others and may result in unsolicited messages from other parties. We have no control over this type use of your personal information and are not responsible for that use. Please exercise caution before sharing any personal information.
M. For any other purpose as otherwise required or permitted by law or as stated at the time you provide your information.
4. INFORMATION ABOUT OUR SITE
A. Visiting our Site: In general, you can visit our Site without telling us who you are or submitting any personal information. However, we collect the IP (Internet protocol) addresses of all visitors to our Site as well as other related information such as page requests, browser type, device identifier (if you are using our mobile app), operating system and average time spent on our Site. We use this information to help us understand our Site activity and to monitor and improve our Site.
B. Cookies: We use certain standard web measurement and tracking technologies such as "cookies," web server logs, web beacons (also known as "action tags" or "one pixel .gif files"), clear GIFs or other statistics programs. A “cookie” is a tiny element of data that our website sends to a user’s browser, which may then be stored on the user’s hard drive so that we can recognize the user’s computer or device when they return. We do this on our Site (including mobile apps) and in emails that we send to you. We collect information about users over time when you use this Site (including mobile apps). We have third parties collect information this way, as well. Your browser may have an option that allows you to accept cookies, reject cookies, or receive notification when a cookie is sent, but you should note that the use of restrictive browser settings may limit your use of the Site.
C. Analytics: Our website uses web analytics services such as Adobe Analytics and Google Analytics. Web analytics services use cookies to help us analyze how visitors use the website. Analytics Sites work by using the information generated by a cookie about your use of the website (including your IP address) for the purpose of evaluating your use of the website, compiling reports on website activity for website operators, and providing website operators with other services relating to website activity and internet usage. 5. HOW WE SHARE YOUR INFORMATION
A. We do not sell, rent or disclose your personal information to third parties without your consent, except as described below or as required or permitted by applicable law.
B. Service Providers: Your personal information may be transferred (or otherwise made available) to third parties that provide services on our behalf. We use service providers to provide services such as hosting a website, processing payments, administering promotions and contests, providing emailing and advertising and marketing services. Our service providers are only provided with the information they need to perform their designated functions and are not authorized to use or disclose personal information for their own marketing or other purposes. Our service providers may be located in the U.S., Canada or other foreign jurisdictions.
C. Business Partners: With your consent, we may provide your personal information to our affiliated companies, co-sponsors or other business partners to use in accordance with their own privacy policies. We may share your personal information so that our business partners, affiliated companies or co-sponsors may provide you with information on the products and services they make available to you through our Site or that may be of interest to you. We share information within the Collective Arts family of brands.
D. Legal and Compliance: We and our affiliates and service providers may disclose your personal information in response to a search warrant or other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise may be required or permitted by applicable Canadian, U.S. or other law or legal process, which may include lawful access by U.S. or foreign courts, law enforcement or other government authorities. Your personal information may also be disclosed where necessary for the establishment, exercise or defence of legal claims and to investigate or prevent actual or suspected loss or harm to persons or property.
E. Sale of Business: We may transfer any information we have about you as an asset in connection with a proposed or completed merger, acquisition or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of our business or as part of a corporate reorganization or other change in corporate control.
F. Where required or permitted by applicable law, we may share information for other reasons we disclose to you.
6. CHOICES AND OPT-OUT
A. Emails: We may use your email address to send emails, newsletters, surveys, offers, and other promotional materials to you, as well as targeted offers from third parties. You can stop receiving promotional emails by following the unsubscribe instructions included in emails you receive from us, or by contacting us using the details below.
B. Mobile Marketing (SMS and MMS) Updates: We may send you text messages relating to our brands, promotions, and other legitimate purposes. If you choose to join a mobile marketing list or participate in any text message program with us, there are typically message and data costs associated with receiving SMS (text) or MMS (multimedia) messages. These will vary based on your wireless carrier and plan. Check with your mobile carrier to determine what charges may apply. If you would like to stop receiving messages from us on your mobile device, reply to the message with “STOP” (or other message as instructed). You may also contact your mobile carrier for additional information on receiving or stopping mobile messages.
C. Location Services: If you have previously enabled location sharing on your computer or mobile device, you may be able to opt out from further sharing by changing the settings on your computer or mobile device or by uninstalling the Application. We will not use any precise location data without your prior consent, which may be obtained directly by us or through our service providers or media partners.
D. Push Notifications: If you wish to disable push notifications on your mobile device, refer to Settings on your mobile device.
E. Third Party Analytics:

7. THIRD PARTY APPLICATIONS/ WEBSITES
A. Social Networks/Online Communities
On certain Sites, we may enable you to access online communities for sharing information such as messages, photos, and videos. We may also enable you to post content from some Sites to your profile on other social networks. We cannot control any policies or terms of such third party social networks. For example, sharing such information with Facebook may require us to implement cookies and/or APIs in order to facilitate the communication between our Sites and Facebook. That information, shared through cookies and/or APIs, then becomes subject to Facebook’s Data Policy, located at https://www.facebook.com/full_data_use_policy. As a result, we cannot be responsible for any use of your information or content by a third party social network, which you use at your own risk.
B. Linked Sites
Our Sites may contain links to third-party websites or applications not controlled by Collective Arts or covered by this Privacy Policy. If you submit information to any of those websites or applications, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website or application that you visit. We have no control or authority over third-party sites and are not responsible for any information that you may submit on that site.
C. Transactions
In some cases, we may use a third-party payment service to process purchases made through the Sites, including but not limited to reservation booking sites, consumer promotions sites, and eCommerce/online retail shop sites. In these cases, your information may be collected by this third party and not by us, and will be subject to the third party’s privacy policy, rather than this Privacy Policy. We have no control over, and are not responsible for, this third party’s use or disclosure of your information.
D. Widgets and Interactive Applications
Our Sites may include interactive programs that provide specific services from another company, such as “liking” or sharing content, often referred to as widgets. You may have the opportunity to submit Information, such as your email or phone number for collection through a widget. A widget may also use cookies and/or collect usage data. Information collected by a widget is governed by the privacy policy of the company that created it.
8. SECURITY AND STORAGE OF INFORMATION
Collective Arts uses administrative, technical, and physical security to protect the Information we maintain to ensure that it is used according to this Privacy Policy. Please be aware though that, despite our best efforts, no security measures are perfect or impenetrable. If you have reason to believe that your Information is not secure, please contact us immediately in accordance with the contact information below. In the event that we are required by law to inform you of a breach to your personal information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.
We will store your Information for as long as is reasonably necessary for the purposes for which it was collected, as explained in this notice. In some circumstances, we may store your Information for longer periods of time, for instance where we are required to do so in accordance with legal, regulatory, tax, or accounting requirements.
9. CHANGES TO THIS PRIVACY POLICY
Your use of the Sites, and continued use of the Sites following any changes to the Privacy Policy, signifies that you agree with the terms and conditions of the Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Site or provide any Information to us.
Additionally, we may update this Privacy Policy from time to time by posting additions or modifications to this page, so we encourage you to periodically review this Privacy Policy.
To help you stay current of any changes, we take the following two steps: (i) we note the date the Privacy Policy was last updated above; (ii) when we make a material change to the Privacy Policy, we post conspicuous announcement of such changes on the homepage of the Site next to the link to this Privacy Policy or we send an email to all users for whom Collective Arts (or the appropriate business unit) has Information. In certain situations, we may send you an email advising you of the new Privacy Policy. Your use of any Site following the posting of any revised Privacy Policy shall be deemed acceptance of the revised policy, so we strongly recommend that you review the Privacy Policy periodically.
